Booking Terms and Conditions
Your Contract with Africa Select
In
order to book a holiday with Africa Select, you must complete and sign our printed booking form
and pay the deposit referred to in paragraph 3 below. When you sign the booking form, you and
all of the other persons referred to in the form are confirming that you understand and accept
these Booking Conditions. Before your booking is confirmed by Africa Select, we reserve the
right to alter the Booking Conditions. Once your booking is confirmed by Africa Select, a
legally binding contract will arise at that point between you and Africa Select. This contract
will be governed by English law and be subject to the jurisdiction of the English Courts.
Our Commitment to You
Our sole aim is to make sure that you have a thoroughly enjoyable holiday. Once a contract has
been formed between you and Africa Select in accordance with the above paragraph, we agree to
provide you (subject to the conditions set out below) with a holiday comprising the individual
itinerary discussed between us and referred to in the confirmation of your booking when this is
provided to you.
Paying for your Holiday
A non-refundable deposit of £300 must be received by Africa Select in respect of each person
referred to in the Booking Form, together with the completed Booking Form. The names listed on
the Booking Form will be transferred to your flight bookings. Such names should be the same as
they appear in your passport. Africa Select will confirm your booking in writing, and a final
invoice will be sent to you twelve weeks prior to departure. The balance of the holiday price,
which will be shown in your final invoice, is payable in full twelve weeks (ie 84 days) prior to
departure. If we do not receive full and final payment by such time, we reserve the right to
cancel the holiday, whereupon the cancellation charges outlined in paragraph 4 below will apply.
If the booking is made within eight weeks of departure, full and final payment must be made at
the time of booking.
Changes to your Booking
If you wish to make changes to your booking details once confirmation has been issued by Africa
Select, a charge of £30 per alteration will be levied. Notification of these changes must reach
us eight weeks prior to departure.
The Price of your Holiday
Africa Select cost your holiday using international currency rates issued at the time of booking
and at the time of any subsequent changes to your itinerary. We guarantee that no surcharges
will be issued by Africa Select once confirmation of the booking or subsequent changes have been
received, excluding only any increases in government taxes, fuel surcharges, and landing fees in
the country of destination and departure.
Cancellation of your Holiday by You
If you wish to cancel your holiday, notification of such cancellation must be received by Africa
Select in writing from the person to whom the holiday is invoiced. The following cancellation
charges will be made :
Length of time before departure |
12 weeks (ie 84 days) or longer |
............... |
Loss of deposit |
6 to 12 weeks (ie 42 to 84 days) |
............... |
50% of total holiday cost |
6 weeks (ie 42 days) or less |
............... |
100% of total holiday cost |
If you have booked insurance through us, the insurance premium is
also forfeited by you on cancellation. However, if the reasons for your cancellation fall within
the terms of your policy, any cancellation charges should, of course, be refunded by your
insurance company. |
Cancellation of your Holiday by Africa Select
Africa Select reserve the right in any circumstances to cancel your holiday for any reason. This
will normally only be due to circumstances beyond our control. If we do cancel the holiday, an
alternative holiday of similar standard will be offered to you. If this is not acceptable, any
monies paid by you to Africa Select will be refunded. We do not accept any liability for any
loss or damage arising out of any cancellation on any account whatsoever.
Alterations to your Itinerary
It is in the nature of the holiday to be provided to you by Africa Select that arrangements and
participation have to be flexible. You may be traveling to some very remote locations, and often
the standards we are accustomed to in the western world may not be practical or possible. The
itinerary of the holiday is an aim and not a contractual agreement between you and Africa Select.
Africa Select may find it necessary to change elements of your itinerary due to local
circumstances or events, and reserve the right to do so. We will notify you of any changes as
soon as it is practicably possible. It is a term of your contract with Africa Select that you
accept that we cannot be held responsible for delays or alterations to your itinerary, or any
increase in the cost of your holiday incurred due to international or domestic flight delays,
diversions, re-schedulings or cancellations, strikes, sickness, weather, war, quarantine, force
majeure, political unrest, natural disasters, or acts of God. In the event of any of the above,
you will be responsible for any additional costs incurred. These costs may, however, be
recoverable from your insurance company depending on the terms of your policy.
Your Health and Safety
Your booking is accepted on the basis that you and all the other persons referred to in the
Booking Form understand the potential risks involved in the holiday and that you and other
persons referred to in the Booking Form are mentally and physically capable of participating in
any of the activities undertaken whilst on the holiday. Africa Select and their agents and
employees are not responsible for any death, illness or physical injury to persons or loss or
damage to property arising from or connected in any way to the holiday booked by you. Your
statutory rights remain unaffected.
Your Personal Insurance Requirements
To participate in a holiday provided by Africa Select, it is a requirement that you must have
adequate insurance. This must include air evacuation and repatriation if you become too ill to
continue. We have an insurance scheme which is specifically designed for the holidays we
provide, and we recommend that you use it. We reserve the right to cancel your booking if we are
not satisfied that you or the persons referred to in the Booking Form have adequate insurance
in place by the date of departure.
Medical and Visa Requirements
You are responsible for all requirements concerning medical vaccinations and certificates,
precautions against malaria, visas, international currency, international driving licenses and
passports, and we accept no responsibility if such requirements have not been arranged by you
by the time of departure.
Airlines
As all itineraries are individual, airlines used may vary from itinerary to itinerary. In our
suggested itineraries, we are not in a position to state the intended operator, aircraft type,
and destination airport. In prepared itineraries, transport timings are provided by the carrier
and may be subject to change. Any flights forming part of your holiday are subject to the
general conditions of carriage and conditions of contract of the airline concerned. Such flights
are subject to international law which often limits the airline's liability in respect of death,
delay, bodily injury, and loss or damage to baggage. You are responsible for re-confirming your
flights, checking in at the correct time, and for presenting yourself at the correct times for
all pre-booked elements of your holiday. No credit or refunds are available if you fail to take
up any part of your pre-booked holiday, or if you lose or destroy your travel tickets or other
documents.
Service
If you experience any difficulties or are unhappy with a service or facility provided, we
recommend that you immediately bring this to the attention of your local representative and the
management of the local service provider (eg hotel) so that they can endeavour to correct it as
soon as possible. If the problem is not resolved to your satisfaction and you wish to make a
formal complaint, this should be done in writing to Africa Select within 28 days of completion
of your holiday. No liability will be accepted by Africa Select in relation to any complaint or
problem if you fail to notify us strictly in accordance with this paragraph.
